Terms of Service
Last updated: May 12, 2026
Governed by the laws of the Province of Ontario, Canada
๐ Plain-Language Summary
These are the rules for using kwnrg.com and ordering products or installations from KW Energy Inc. Your installation contract is a separate signed document that takes priority over these online terms. You have a 10-day statutory right to cancel most home renovation contracts in Ontario, and we will never use door-to-door sales or NOSI registrations.
1. About KW Energy
KW Energy Inc. ("KW Energy," "we," "us") is an Ontario-incorporated corporation located at 2425 Matheson Blvd E, 8th Floor, Mississauga, ON L4W 5K4. We are licensed by the Electrical Safety Authority (ESA Licence #7016xxxx), HRAI-certified for heat pump installations, and an approved installer for Ontario's Home Renovation Savings Program (HRSP). HST #80xxxxxxRT0001.
2. Acceptance & Eligibility
By accessing kwnrg.com, our calculators, marketplace, or booking a consultation, you confirm that you are at least 18 years old (the age of majority in Ontario) and have the legal capacity to enter into binding agreements. If you are entering into an installation contract on behalf of a business or property co-owner, you represent that you have the authority to bind them.
3. Our Services
- Online tools: Savings Calculator, Rebate Finder, AI Home Audit, Energy Monitor, Marketplace
- Sales & Consultation: Quotes, system design, financing pre-qualification
- Installation Services: Solar PV, battery storage, heat pumps, EV chargers, electrical work (separate written agreement governs each install)
- Post-Install: Monitoring, warranty service, rebate filing, customer support
4. Sales Practices โ Consumer Protection Act, 2002
Our Commitments to You
- No unsolicited door-to-door sales. Banned in Ontario since March 1, 2018 โ we comply. Any sales presentation at your home occurs only by your prior written or telephone appointment.
- No NOSI. We will never register a Notice of Security Interest against your home, as prohibited by the Homeowner Protection Act, 2024.
- All material terms in writing. Every installation contract over $50 is provided in writing as required by CPA s.13.
- 10-day cooling-off period. You may cancel any direct agreement for goods or services over $50 within 10 calendar days of receiving a written copy, for any reason, without penalty (CPA s.43). Cancellation may be by any means (email, phone, fax, mail).
- 1-year cancellation rights if material terms (price, description, timing, cancellation rights) are missing from the written contract.
- No high-pressure tactics, no false urgency, no misrepresentations.
5. Cooling-Off Period & Cancellation
To exercise your 10-day right of cancellation:
- Email cancel@kwnrg.com or call (613) 909-4835 within 10 days of signing
- Include your name, address, and contract number
- We will refund 100% of deposits within 15 days (CPA s.96)
- If any product was delivered, you must make it available for pickup at your address (we pay for pickup)
After the 10-day cooling-off period, cancellation may trigger a liquidated damages charge equal to documented costs incurred (permitting, engineering, equipment restocking) up to a maximum of 10% of the contract value, as fully disclosed in your installation contract.
6. Estimates, Quotes & Calculator Disclaimers
Calculator outputs are non-binding estimates. Actual production, savings, and payback depend on weather, consumption patterns, utility rates, system performance, AHJ requirements, and rebate program eligibility. Written quotes from a KW Energy consultant supersede any online estimate, and your signed installation contract supersedes any quote.
Estimates do not constitute an offer. A binding offer exists only when KW Energy issues a signed written quote that you accept in writing or by e-signature.
7. Installation Contract Priority
If you purchase an installation, the signed Installation Agreement governs the work, warranties, payment schedule, and dispute resolution for that project and prevails over these Terms of Service in case of conflict. These Terms govern your use of the website and online tools only.
8. Warranties
- Workmanship: 10 years on all KW Energy installation labour
- Solar Panels: 25 years product + 25 years performance (manufacturer pass-through)
- Inverters: 12โ25 years depending on model (manufacturer pass-through)
- Batteries: 10 years or stated cycle life (manufacturer pass-through)
- Heat Pumps: 10 years parts, 10 years compressor (manufacturer pass-through)
- Roof penetrations: 10-year leak warranty on KW Energy mounting
Warranty exclusions: damage from misuse, alteration by non-authorized parties, force majeure (lightning, hail beyond rated specs, flood, fire), pest damage, and natural performance degradation per manufacturer spec sheets. Implied statutory warranties under the Sale of Goods Act (Ontario) are preserved where applicable.
9. Financing
If you elect financing through a third-party lender (Financeit, Mosaic, GoodLeap, Dividend, Sunlight Financial), your loan is solely between you and the lender. KW Energy is not a lender, has no authority to modify loan terms, and receives no kickback contingent on rate. Full lender APR, payment schedule, and total cost of credit will be disclosed by the lender per the Cost of Borrowing Disclosure Regulations.
10. Pricing, Taxes & Payments
- All prices in Canadian dollars (CAD) and exclusive of 13% HST unless otherwise stated
- Deposit required at contract signing as disclosed in your Installation Agreement (typically 10โ25%)
- Progress payments tied to project milestones (permit pulled, equipment delivered, install complete, PTO received)
- Stripe processes online payments โ see Stripe's terms for card processing details
- Pricing in online marketplace listings is subject to availability and may change without notice prior to contract signing
11. Rebates (HRSP & Federal)
We provide rebate application assistance as a courtesy. Rebate eligibility, amounts, and timing are determined solely by the issuing government agency. KW Energy is not responsible for rebate denials, program changes, processing delays, or budget exhaustion. Estimates of rebate values on our site are subject to verification.
12. Online Account & Acceptable Use
You agree not to: (a) attempt unauthorized access; (b) scrape, reverse-engineer, or copy our content or algorithms; (c) submit false information or fraudulent reviews; (d) impersonate another person; (e) use the site for any unlawful purpose. You represent that the content is truthful, your own, and does not infringe third-party rights. Fake or incentivized reviews violating the Competition Act will be removed and reported.
15. Limitation of Liability
Limitations (Subject to Applicable Law)
EXCEPT FOR LIABILITY THAT CANNOT BE LIMITED UNDER ONTARIO LAW (INCLUDING THE CPA, GROSS NEGLIGENCE, WILFUL MISCONDUCT, BODILY INJURY, OR DEATH), KW ENERGY'S AGGREGATE LIABILITY FOR CLAIMS ARISING FROM YOUR USE OF THE WEBSITE OR ONLINE TOOLS IS LIMITED TO THE GREATER OF (i) CAD $500, OR (ii) AMOUNTS PAID BY YOU TO KW ENERGY IN THE 12 MONTHS PRECEDING THE CLAIM.
For paid installation services, liability is governed by your signed Installation Agreement and applicable law. Nothing in these Terms limits any non-waivable rights you have under the Consumer Protection Act, 2002 (Ontario).
16. Indemnification
You agree to indemnify KW Energy against third-party claims arising from your breach of these Terms or your unlawful use of the site, except where caused by KW Energy's negligence.
17. Dispute Resolution
We will try in good faith to resolve any dispute within 30 days of written notice to legal@kwnrg.com. If unresolved:
- Mediation through the ADR Institute of Ontario in Toronto, costs shared 50/50
- Litigation in the courts of Ontario, exclusive jurisdiction
Your statutory rights are preserved. Nothing in this section limits your right to file a complaint with the Ontario Ministry of Public and Business Service Delivery (consumerbeware.mgs.gov.on.ca ยท 1-800-889-9768) or to pursue small claims under $35,000 in Ontario Small Claims Court.
18. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
19. Severability
If any provision is found unenforceable, the remaining provisions remain in full force. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
20. Changes to These Terms
We may update these Terms. Material changes will be announced via email and a site banner at least 30 days before they take effect. Your continued use after the effective date constitutes acceptance.
